We are, as of now, still on track for construction. As you may know, the California Nurses Association has filed a lawsuit under the provisions of the California Environmental Quality Act (CEQA), against Alameda County and the Board of Supervisors, challenging the approval of the final environmental impact report (EIR). The suit seeks an injunction to halt construction.
The union’s lawsuit could derail our ability to meet the State’s 2013 deadline to replace the aging Eden Medical Center. Not meeting the deadline could result in closing Eden hospital before the new hospital is completed and certified for occupancy.

CEQA litigation in the Superior Court can take up to a year. We estimate that a decision may be obtained in a somewhat shorter time frame, possibly by Spring 2010. In the meantime, we are continuing with the construction project in order to meet our obligations under California law.</description>
